Acceptance of Terms

By downloading, installing, or using the Khamsa Muslim Prayer Tracker app, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the app.

Acknowledgement

You acknowledge that this End-User License Agreement (EULA) is concluded between you and the developer (Khalid Adam) only, and not with Apple. The developer, not Apple, is solely responsible for the Licensed Application and its content. This EULA does not provide for usage rules that are in conflict with the Apple Media Services Terms and Conditions.

Scope of License

The license granted to you for the Khamsa Muslim Prayer Tracker is limited to a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The app may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

Maintenance and Support

The developer is solely responsible for providing any maintenance and support services with respect to the Khamsa Muslim Prayer Tracker, as specified in this EULA or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.

Warranty

The developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Khamsa Muslim Prayer Tracker to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the developer's sole responsibility.

Product Claims

You acknowledge that the developer, not Apple, is responsible for addressing any claims of yours or any third party relating to the Khamsa Muslim Prayer Tracker or your possession and/or use of that app, including, but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the app's use of HealthKit and HomeKit frameworks.

Intellectual Property Rights

You acknowledge that, in the event of any third party claim that the Khamsa Muslim Prayer Tracker or your possession and use of that app infringes that third party's intellectual property rights, the developer, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third Party Terms of Agreement

You must comply with applicable third party terms of agreement when using the Khamsa Muslim Prayer Tracker. For example, if you use features that require network connectivity, you must not be in violation of your wireless data service agreement when using the app.

Third Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of this EULA. Upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against you as a third party beneficiary thereof.

App Usage

The Khamsa Muslim Prayer Tracker is designed to help users track their five daily Islamic prayers (Fajr, Dhuhr, Asr, Maghrib, Isha). The app is provided for personal, non-commercial use only. You may not use the app for any unlawful purpose or in any way that could damage, disable, or impair the app.

Data Responsibility

You are responsible for the accuracy and completeness of the prayer data you enter. The app provides tools for tracking prayers, but it is your responsibility to ensure your prayer practice aligns with Islamic teachings and requirements.

Privacy and Data

Your privacy is important to us. All prayer data is stored locally on your device. Optional iCloud synchronization is available if you choose to enable it. Please refer to our Privacy Policy for detailed information about data handling.

Subscription Terms (Khamsa Pro)

Khamsa Muslim Prayer Tracker offers auto-renewable subscription options for Khamsa Pro. By subscribing to Khamsa Pro, you agree to the following terms:

  • Monthly Subscription: $0.99 per month. Includes a free one-month trial. You can cancel at any time. If the trial period expires and you have not cancelled, you will be billed at the monthly rate.
  • Yearly Subscription: $0.83 per month, billed annually ($9.99 per year). Includes a 16% discount (effectively two months free).
  • Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Cancellation: You can manage or cancel your subscription at any time through your Apple ID account settings.
  • Payment: Payment will be charged to your Apple ID account upon confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Intellectual Property

The Khamsa Muslim Prayer Tracker app and its content are protected by copyright and other intellectual property laws. The app's design, Islamic content, and functionality are the property of the developer.

Disclaimer of Warranties

The app is provided 'as is' without warranties of any kind. We do not guarantee that the app will be error-free, uninterrupted, or meet your specific requirements. Use of the app is at your own risk.

Limitation of Liability

In no event shall the developer be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the app.

Islamic Content Accuracy

While we strive to provide accurate Islamic information, the app is not a substitute for qualified Islamic scholarship. Users should consult with knowledgeable Islamic scholars for religious guidance and rulings.

Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will be reflected in the app with an updated effective date. Continued use of the app constitutes acceptance of the modified terms.
